I feel that if the characters are engage in sexual acts it should be defined as pornography, and if they're just standing or posing nude it should be defined as art.

Some people will make the argument that people engage in sexual acts can be defined as art, too, I just don't agree with it.

The objective of hentai is to be sexually explicit in nature, so I'd say that's pretty much pornography.

I agree with everything ViLky has said here. If they are engaged in sexual acts then it should be defined as pornograhpy, if its nude pics then it should be classed as art.

Does it have to be mutually exclusive? Can't something be both pornography and art?

Hentai, if I remember correctly, translates to "pervert". But I could be wrong but otherwise, I'd think it's a clear statement.

Most pornography is not out there to be artistic. Most of it is lame, repetitive shit and the rest is fetish stuff which is even more bizarre. Hentai is no different. After being an awesomely rebellious teenager by surfing 4chan every once in awhile, I learned very quickly that the most likely estimate for "tasteful Japanese erotic art" as a percentage is around 1.4%. The rest is tentacles and almost nobody wants that.

I feel exactly the same way about this. The purpose of Hentai is to be pornographic.

I would have to say that sexual acts could be considered art, or at least it's not totally out of the realm of possibility. Nude pictures are certainly not all classified as art, though. Perception is relevant but I think we can agree that hentai's general purpose is to cause sexual arousal (Which is the definition of pornography).

I concur. The concept of Hentai being even remotely classified as "art" I just find myself disagreeing with altogether.

The purpose of hentai is to sexually excite people, so it really should be legally defined as Porn.
