BOSTON - The winner of a $1 million lottery scratch ticket may not be so lucky after all: He's a convicted bank robber who isn't supposed to gamble.

Timothy Elliott faces a Dec. 7 court hearing over whether he violated his probation when he bought the $10 ticket for the $800 Million Spectacular game at a supermarket in Hyannis.

Elliott was placed on five years' probation after pleading guilty in October 2006 to unarmed robbery for a January 2006 heist at a bank on Cape Cod. Under terms of his probation, he ``may not gamble, purchase lottery tickets or visit an establishment where gaming is conducted, including restaurants where Keno may be played.'',0,2170943.story

As cruel as it sounds, I say they take it away from him and give it to charity.

I see it as what he gets for being a bank robber. He probably can't gamble because he never paid back the money he stole. I assume he did some time but that doesn't pay back the money he stole.

If he's not allowed to gamble then the money he won shouldn't even count towards his debt. He needs to find a job and get money like the rest of us.

Now do I agree with him not being able to gambe? I could go either way but I do think he should have a very small budget allowed to spend on gambling.

Whatever the circumstances were, I'm sure he knows people who could have purchased the ticket for him.. Oops.

i dont think he deserves it cause he violated his probation. he shouldnt of broke the law if he wanted that. well goes to show u how reallity will bite u in the butt.
